Welcome, and thank you for considering Zanalytics Consulting. These Terms of Service ("Terms") govern your purchase of the Zanalytics Website Build Guide, your engagement of consulting or professional services from Zanalytics Consulting, and your use of the website at zanalyticsconsulting.com. By purchasing the guide, engaging services, or using this site, you agree to these Terms.

Zanalytics Consulting ("Zanalytics," "we," "us," or "our") is a consulting practice operated by Shelbi Cox, based in Murrieta, California.

Service agreements supersede these Terms. Any signed proposal, statement of work, contract, or written agreement for a specific engagement controls over anything stated here, and terms may be arranged differently on a per-project basis. These Terms apply where no separate agreement is in place.

1. Eligibility & general conditions

Who can purchase

You must be at least 18 years old to purchase the Guide, subscribe to a plan, or enter into any service engagement with Zanalytics Consulting. By making a purchase, you confirm that you meet this requirement.

Electronic communications

By purchasing the Guide, subscribing to a plan, or contacting us through this website, you consent to communicate with Zanalytics Consulting electronically, primarily via email. Email is our official channel for receipts, updates, support, and other notices related to your purchase or engagement.

Use of AI tools

Zanalytics Consulting uses AI tools (including large language models such as Claude and related platforms) as part of the creation of the Guide, our website, and the work we deliver for clients. Human oversight, editing, and judgment are applied throughout, and confidential client information is handled with care. If you have specific requirements or restrictions around AI use for a given engagement, please tell us before we begin and we'll note it in the project agreement.

Privacy

Our Privacy Policy is incorporated into these Terms by reference and explains how we collect, use, and protect your information.

2. Terms for the Website Build Guide

The Zanalytics Website Build Guide (the "Guide") is a digital product designed to help you build your own website using the step-by-step process, screenshots, and sample prompts included inside.

We reserve the right to revoke access to the Guide and the download link, without refund, if we determine in good faith that the Guide has been shared, redistributed, or used in violation of these Terms, or if a payment is reversed, charged back, or otherwise not honored.

Disclaimer & release of liability

This Guide is provided for informational and educational purposes only. While a lot of care has gone into making it as helpful and accurate as possible, we make no guarantees about the results you'll achieve. Every project is different, and outcomes depend on many factors that are unique to you — your content, your tools, your decisions, and how things come together along the way.

By using the Guide, you acknowledge that you are choosing to take on this project on your own (or with the help of AI tools and third-party platforms), and that you are responsible for the decisions you make throughout the process. Zanalytics Consulting and Shelbi Cox are not liable for any damages, losses, or issues that may arise from following the steps outlined in the Guide, including but not limited to technical issues, hosting problems, domain configuration, data loss, or any costs incurred through third-party services.

The Guide references third-party tools and platforms (such as Claude Code, Netlify, VS Code, Dropbox, and others). We are not affiliated with, endorsed by, or responsible for any of those services. Their availability, pricing, and functionality may change at any time.

In short: the Guide was made to help you, and we genuinely hope it does. But it is a guide, not a guarantee — and you are in the driver's seat.

Updates & ongoing maintenance of the Guide

We reserve the right to update, revise, or discontinue the Guide at any time. We will make reasonable efforts to keep it helpful and current, but we release liability for any portion of the Guide that becomes outdated, inaccurate, or no longer applicable due to changes in third-party tools, platforms, or best practices.

Copyright notice

The Guide and all of its contents — including the text, structure, templates, prompts, and methodology — are the original work of Shelbi Cox via Zanalytics Consulting and are protected under copyright law.

You may not reproduce, distribute, resell, or republish the Guide in whole or in part without prior written permission. This includes sharing it publicly, repackaging it as your own, or using it as the basis for a competing product or service.

Purchasing or receiving the Guide grants you a personal, non-transferable license to use it for your own projects. That's it — it's all yours to use, but not yours to share. If you'd like to reference, quote, or share a portion of the Guide, please reach out first. We're happy to talk about it.

4. Subscription & auto-renewal (All-in-one monthly)

The All-in-one monthly plan is a recurring subscription that includes the initial website build and ongoing hosting, maintenance, and small updates for a flat monthly fee. The following terms apply to the subscription, in addition to any project agreement that may be in place.

We may change the subscription price from time to time. If we do, we will notify you by email before the change takes effect, so that you have an opportunity to cancel if you do not agree to the new price.

5. Refund policy

All sales are final. Due to the digital and service-based nature of our offerings, we do not offer refunds on the Website Build Guide, completed consulting work, monthly subscriptions, workshops, coaching sessions, or any other product or service.

That said, your experience matters to us. If something isn't working for you, please reach out. We're happy to troubleshoot issues with the Guide (such as broken download links), discuss concerns about a service engagement, or work with you to find a solution when something falls short of expectations. 6. Chargebacks & payment disputes

If you have a concern about a charge (for the Guide, a subscription, or a service), please contact us first at Shelbi@zanalyticsconsulting.com so we can look into it and try to resolve it directly. In most cases we can sort things out quickly.

By purchasing the Guide or subscribing to a plan, you agree not to file a chargeback, payment dispute, or reversal with your bank or card issuer without first giving us a reasonable opportunity to address the issue. Chargebacks filed without contacting us first may result in revoked access to the Guide, suspension of active services, and recovery of disputed amounts and related fees.

7. Intellectual property

All content contained in the Website Build Guide, on this website, and in deliverables produced by Zanalytics (including written content, frameworks, templates, methods such as the EASE Method, visuals, and code samples) is the property of Zanalytics Consulting and Shelbi Cox unless otherwise noted.

When we complete a custom engagement for you (for example, a done-for-you website build or a strategy deliverable), you receive a license to use the final deliverable for your business. Underlying frameworks, methodologies, templates, and reusable code remain the property of Zanalytics and may be used in future engagements.

Zanalytics Consulting is committed to making our website accessible to the widest possible audience, including people with disabilities. We aim to meet or work toward the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards where practical.

What we do

Ongoing improvements

Accessibility is an ongoing commitment, not a one-time project. We review and update our site regularly. Some third-party content (embedded forms, external links, or legacy assets) may not be fully under our control, and we work to substitute accessible alternatives when possible.

For websites we build for you. When we design and build a website for a client, we follow accessibility best practices and aim to deliver a site that meets WCAG 2.1 Level AA standards at launch. Ongoing accessibility after launch depends on future content, plugins, and changes made to the site, which are the client's responsibility unless covered under an active maintenance plan.

10. Disclaimers & limitation of liability

All services, guides, and content are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. While we bring professional experience and care to every engagement, we do not guarantee specific outcomes, revenue, traffic, conversions, or business results.

To the maximum extent permitted by law, Zanalytics Consulting and Shelbi Cox will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your purchase of the Guide, engagement of our services, or use of this website. Our total liability for any claim related to the Guide, a service engagement, or the website is limited to the amount you actually paid for the specific product or service giving rise to the claim.

11. Force majeure

We are not responsible for delays or failures in delivering the Guide, subscription services, or any other work caused by events outside our reasonable control. This includes, but is not limited to, illness or medical emergencies, natural disasters, power or internet outages, hosting or third-party platform failures (such as Stripe, Dropbox, Netlify, or similar providers), changes in law, government action, or other circumstances beyond our control. In any such event, we will make reasonable efforts to communicate and resume service as soon as reasonably possible.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising under or related to these Terms will be resolved in the state or federal courts located in Riverside County, California, unless the parties mutually agree to an alternative forum or method of dispute resolution.

14. Changes to these terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of the website, the Guide, or our services after an update constitutes acceptance of the revised Terms. For active engagements, the Terms in effect at the time the engagement was contracted will continue to govern that engagement unless both parties agree otherwise.
